Terms of Service

These terms govern your use of the Deucalion® mobile application and web portal at deucalion.uk ("the Service"), operated by Deucalion® ("we", "us", "our"). By using the Service, you agree to these terms.
1. The Service
Deucalion® is a compliance inspection tool for smoke control and fire damper engineers. It provides digital checklists, photo evidence capture, certificate generation, defect tracking, quoting, and team management features.
2. Eligibility
You must be at least 16 years old and a qualified or trainee engineer (or authorised representative of an engineering firm) to use the Service. By creating an account, you confirm you meet these requirements.
3. Your account
You are responsible for maintaining the security of your account credentials. You must not share your login with others. If you believe your account has been compromised, contact us immediately. We may suspend accounts that show signs of unauthorised access.
4. Subscriptions and payment
Deucalion® offers a free tier, paid subscription plans, usage credit packs, organisation team billing, and seat add-ons. In-app subscriptions are billed through Apple (App Store) or Google (Play Store) and managed via RevenueCat. Web checkout, credit packs, organisation team subscriptions, seat add-ons, hosted invoices, and billing portal sessions are processed by Stripe where enabled. Payment card details are handled by the relevant payment processor; Deucalion® does not store full card numbers or CVC codes.
Credit packs are usage credits for the relevant Deucalion® feature, such as chat, report generation, or Sift runs. Credits are not cash, e-money, or stored value, cannot be resold or transferred outside the Service, and may be consumed when the relevant feature is used. Organisation credit packs and seat purchases may be managed by workspace owners or admins and may affect shared workspace balances or seat capacity.
Subscription management, refunds, and cancellation for App Store and Play Store purchases are governed by the relevant store terms. Stripe-hosted purchases, invoices, billing portal sessions, team subscriptions, and seat changes are governed by Stripe's checkout and billing flow plus these terms. Seat changes to an existing Stripe subscription may create immediate invoices or future recurring charges depending on the billing configuration shown at checkout. Refunds are not automatic after credits or services have been used, but we will correct verified failed, duplicate, wrong-account, wrong-workspace, or wrong-feature charges. Where a refund is due, we will initiate it through the relevant processor within 10 business days of verification unless a shorter legal period applies.
We may change pricing or features with reasonable notice. Existing subscriptions will not be affected until the next renewal period unless you make a checkout, seat, or plan change that clearly shows the new billing terms before confirmation.
5. Your data
You retain ownership of all inspection data, photos, reports, and other content you create using the Service. We do not claim any intellectual property rights over your content. See our Privacy Policy for details on how we handle your data.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to other users' accounts or data
- Reverse-engineer, decompile, or extract source code from the application
- Use automated tools to scrape, crawl, or extract data from the Service
- Interfere with the operation or security of the Service
- Resell, sublicense, or redistribute access to the Service without our written consent
7. AI features
The Service includes AI-powered and machine-learning-assisted features such as chat, transcription, OCR, knowledge search, Sift document extraction, inspection analysis, and report drafting. These features may process your prompts, audio, images, uploaded document text, inspection context, and draft outputs through Deucalion® systems and third-party AI or extraction providers where enabled. AI-generated output may contain errors and must be reviewed before use in professional reports, compliance records, customer documents, or advice. AI features are provided as-is to assist your workflow, machine-learning systems may produce inaccurate or incomplete outputs, and use of AI features is subject to the limitation of liability in section 10. You are responsible for the accuracy of any inspection data, reports, and customer-facing outputs you submit or share, and you must not upload content that you do not have the right to process.
8. Compliance and professional responsibility
Deucalion® provides tools to support BS 7346-8 compliant inspections. However, compliance with applicable standards, regulations, and codes of practice remains your professional responsibility. The Service does not replace professional judgement, and we do not certify or guarantee that inspections conducted using the app meet any specific regulatory standard.
9. Availability and support
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. The offline features of the mobile app allow continued use during periods of connectivity loss.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim. Nothing in these terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
11. Termination
You may request an account export or schedule account deletion from your account where the feature is available, or by contacting support. Account deletion is scheduled with a 14-day grace period and can be cancelled before finalisation. Once finalised, your authentication account is deleted, access is deactivated, personal profile fields are anonymised, device tokens are removed, API keys and webhooks are disabled, and organisation memberships are removed. Inspection records, photos, certificates, quotes, defect reports, organisation, billing, tax, audit, security, and compliance records may be retained where required by law or legitimate compliance purposes. We may suspend or terminate your access if you breach these terms. On termination, your right to use the Service ceases and data is retained or deleted in accordance with our Privacy Policy.
12. Changes to these terms
We may update these terms from time to time. Material changes will be communicated via the app or email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
